    I'm not sold on this being "stolen," he could have simply bought the rights to the image. It's a stock resource.

     

    ArchMadness, however, is more along the lines of thievery. If he can prove first rights, he might have a viable case in court, should he pursue it.

    I agree, but BMA said "a week" 12 days ago. (it's fine, BMA, we understand) TVIXX, and myself, frankly want to know if there is any update. He is not being impatient, just wanting a check-in.

    I would do a X award for best concepts in each sport. Not as glamours but something nice to have as a award

    Thing is: logos are still logos, regardless of sport. Having a best concept per sport would be a bear, seeing how many different concepts get posted for different sports daily - not to mention the concepts for fictional sports like Yakball and the Reflex League (nothing against it!). Football, Basketball, Baseball, Racing, Quidditch, Pro sports, College Sports, Minor League Sports...it would be like a participation award if you expand it for each sport category, and you run the risk of "offending" someone for not including their obscure sport as it's own category.

  4. What's even better, is that his other project is not completely original either. He mentions, "Diego Guevara" as inspiration for his Atlantic City FC project.

    You are correct. Not only did they steal it, but they removed what I believe are necessary details and made a pretty lame shirt out of it.

    You could always set up a redbubble store or a Design By Humans store and sell it yourself. I know it's not much in terms of "protecting your work," but at least it combats it by theoretically pulling sales away from him.

    That sort of blind ambivalence is the most dangerous: that if a person/organization is big enough, it's not as bad - when in fact, it's way worse. Sure, they kept Wonka's name on the post, but it doesn't look like they credited him at all.

    Can someone give more insight on this specific situation?

  7. One more thing about copyrights - whenever a piece of work is made (photo taken, drawing completed, etc), the owner of the work is entitled to a copyright on that piece. That alone doesn't hold much weight in court, but it's a given in protection. One can always go the extra step and actually claim the copyright. You can do this straight through the US Copyright's website. I think it's only $35 per piece. But this would certainly be a last ditch resort.

    yes $35 a piece. but that "piece" is the important part. dont spend $35 on EVERY logo and bit of work you do. make a book, put everything in it, then for the same price, all of your work in it is protected

    This is a much cheaper way to do it...I had a twitter photo stolen and used on a very bad Alabama website that mocked me, Auburn, and everything else and they never credited to me and it infuriated me. So I had some guys tell me about the $35 per piece.

    If I remember my IP Law class correctly, you could copyright a website and continually upload your content to it and not even need a book.

  8. let me offer some advice.

    if this guy is sharing your work, allow him to do so. spread it around as much as possible. if it were a twitter thing i would RT with something like "thanks for sharing my X concept". never shy away from exposure,

    if he is taking credit for your work, call him out on it. i think Wilcox probably did everything right in this situation in contacting instagram and such. just let everyone you know know that its your work and let him know you dont appreciate him being a twat

    if he is making money from your work, this is where it gets good. keep your sketches and original files and everything you have of the work to prove you did it. the final work needs to be copyrighted. if anyone steals and profits from your work, you can claim their profits. lawyers should see your case and jump at this opportunity. and they dont get paid unless you do. i believe the minimum court settlement on copyright infringement is $25,000 but id have to double check that number.

    The bottom line, unfortunately, is this: if they're not directly making money off the "plagiarism," there isn't a whole lot you can do aside from asking "Hey, either give me credit or please stop posting my work" or (going off Moore's advice) feigning gratitude with a "Thanks for sharing my work!" tweet/comment. You could even go one step further and somewhat hijack the post by saying "Thanks for the kind words about my work! If you'd like to see more, check out my website/portfolio here!"

    Every situation is different, but all points offered in this thread are extremely valid.

  9. Watermarking the hell out of my concepts hasn't helped. avconcepts went private and he's blocked me. Anybody want to spy on him?

    That's kinda my point.

    His bio now says "I make my own designs/logos and. (post concepts from all over )"

  10. I had this happen to me pretty recently as well - Remember my Washington Nationals redesign? The SAME GUY ripped it - twice.

    I was able to get him to credit me for the original design, but the biggest problem I have with it is: He's the "Head Guy" over at NFLMemes, which means he should know better.

    I don't know if there's any "true" way we can protect our work, aside from watermarking the hell out of it.

  11. Curious? Using photoshop cs2 (I think I have cs2)

    How can I create a vector image of the embroidery? Not the black background. I've never used photoshop before so I have no clue.

    Photoshop is actually a raster-based program, not a vector-based program. So anything you make in Photoshop will (unfortunately) be a raster image, unless you almost exclusively use shapes to make your image. If you want a vector image, you'll be much better off using Illustrator (if you're going to stay in the Adobe family.)

    This is such a great little thread on Photoshop techniques. I am fairly new (6 months) to Photoshop/Illustrator/Inkscape and the creation process. I am trying to convert skyline photos so that it only employs two main colors. I was hoping you could help me out in how to create the effect with both the coming through the photo.

    I have been playing around but have hit a wall with this. I know you set the photo to "greyscale" first. I can make it so I have the primary color and either black or white (depending on using Multiply or Screen blending). But I can't figure out how to get the second color to take the place of the black or white. Is there a way to convert the secondary color in the "greyscale" to any other color so that when you use Multiply it allows the blending of the two colors? I just can't figure it out plus there is no actual thread on here or any forum I can find on this process. Can you please help me out. Thanks.

    I'm getting there on the closer in Doug Martin image- I think I have the helmet somewhat figured out. One question is how big to make the file? The original is 4912 x 7360. That would be immense by the time I added in all the layers needed and would give the file sharing programs fits. 600 x 800 is probably smaller than most people want to play with. Somewhere in there's a happening medium.

    Lookin good! The size of the template should reflect where you intend to use it. The 4912x7360, I'm assuming is at 72 ppi for it's resolution. When you convert it up to 300 ppi (optimum for printing hi-res), that's about a 16x24 print. I'd knock it down to 11 inches tall at 300 ppi. That should give you the most versatility. If people are gonna download it, they can always scale it further down themselves.

  14. Question of legality: if you were to put these on shirts and sell them yourself, would the teams still have rights to the logos/a claim of copyright infringement?

    If not, REN, TOTALLY STEAL THAT IDEA I JUST HAD AND CALL ME WHEN YOU'RE A HUNDRED THOUSAND-AIRE
