I'm in a fantasy football league (we're so happy for you) and my league actually uses logos and cities like my team is the Chicago Condors (which I "borrowed" from the defunct womens' basketball team of the same name). I don't think there's a problem there because I'm not suing it in a money-making endeavor (especially the way my team has finished the last few seasons). However I noticed a baseball team using a modified version of it which makes me wonder if (A) anyoen can use the logo if the team it was designed for ceases to exist or (B) a new team must pay the original designer of the logo to use it again.

Anyone know?

random_ax, just don't try and profit off the reproductions or let it be known too widely you reproduced them. That's all I can suggest because its all I know dude. Just trying to be helpful

All I can say is do what you think is best. People here will say yea or nay soon enough. I'd say go and make your own logo if for no other reason than to improve your design skills!

I sensed no urgency on this post; capitals are not necessary.

it's not typically couth to use other people's copyrighted designs, but it's generally accepted for fantasy logos. and if you're using the logo of a defunct team, you can't claim that another team is "stealing" your logo - you yourself are technically "stealing" a logo and have no legal claim to it. ownership rights are variant depending on the team and league and designer - sometimes a league retains ownership of design work if a team goes belly up, sometimes its the designer. in any case, you using it for a fantasy logo have no claim on the logo whatsoever.

Caps? Who cares? He only used them in part of his topic's question. I didn't even notice the topic had capitals, really... Granted, caps can be annoying when an entire long article is written in them; but people have obviously gotten WAY too anal about this.

As far as the question is concerned, I don't know for sure but I would assume that an obsolete league's logos would often be considered "fair use" and therefore open to being used. Naturally each case could be different, as rightholders may still own the logos in some cases. And even if a team has been history for a while the team or franchise, if it still exists, may still own it.

As long as you aren't profiting from using it (e.g., selling shirts using it, etc.) there are probably many cases where you could get permission. So any of a number of things could be the case.

Alright guys, let's take a step back and remember that this is really not worth getting all hot and bothered over. The capitals have been edited now.

random_ax, we'd appreciate if you refrained from capitalizing your topic titles and striving to use proper grammar and spelling in your posts. It just helps maintain a level of decorum and sanity in the often bizarre world of internet forums. We don't ask for perfection, we just ask that you put in an effort.

As far as the rest of you go, remember, a harsh word stirs up anger, but a kind word turns away wrath. Let it go, and don't escalate the situation just 'cause someone said something that annoyed you.

As far as fantasy logos go... speaking from personal experience, I don't like it when fantasy teams use my logo without prior permission. In many cases, this is how the logo gets perceived as being public domain (when in reality all the logos on my site are explicitly protected, and where appropriate, credited to other original owners).

When it comes to professional teams, rarely is there any doubt to whom the logo actually belongs (no person with half a brain would mistake the, say, Atlanta Falcons logo for being a piece of clipart), so they usually won't show much concern.
