Well, status report:

-I'm not sure the email was seen by the webteam instructor, knowing the guys it was emailed to they probably read it and deleted it, but I'm not sure...

-I ordered 5 t-shirts for me and a few guys who agreed to wear them, that's going to be fun.

-Right now I'm going to sit back and see if that email has any effect on the removal of the logo, if things don't start happening, I'll get it taken off somehow.

Relax for a bit. A lot is happening. Rome wasn't destroyed in a day. If you make it too blatant, you might end up the recipient of some of his pansy wrath.

Well, so far they haven't made an effort to take it off. Of course one excuse is that to remove the logo they have to redo the Flash animation and take it off of all the football pictures (I'm not sure if they sold those yet, but either way they're going to). My response to that: You shouldn't have stolen the damn logo! And of course there are still people who firmly believe that he designed it himself. I talked to my graphic design teacher and he said they should take it off because it's obviously copyright infringement, so at least he's sticking with me on the issue. On the plus side, the Hawaii shirts will be at my door in a couple of days.

So what do I do now that it seems they're doing nothing? Wait it out? Talk to the webteam instructor? Talk to the guy? (seems that may end ugly) Or take it to the administration?

Contact the University of Hawaii's Athletics Department. Advise them of the situation and advise them to send a cease and desist letter.

Once the school receives it, you'll see them move faster than :censored: through a goose.

This is the best option. Hawai'i will move quickly. I think the University of Notre Dame went after a HS in Ohio that blatently ripped off the ND Leprechaun logo about 10-12 years ago. The school had to get all new uni's and had to get the basketball court redone; not to mention the penalties that were imposed. You could be saving the school district a significant chunk of cash if this logo begins to proliferate.

Well. if you advise them to send a cease and desist letter, you'll just sound bitter. Let them know about the issue, and let them figure out what to do. I trust that they'll know. Whether they choose to act would be up to them. I have to believe that some schools DON'T care, while we know that others do.

This is my proposed plan:

Set up a meeting with one of the administrators. During the meeting, inform him of the situation, showing all the accumulated evidence of the stolen logo. Explain my main points:

-If plagarism in English class could get anyone expelled, plagarism in this class, Web Team, should be treated the same (I don't want the kid expelled, I just want discipline handed out).

-The last thing any school needs is a lawsuit. This logo needs to be removed before a snowball effect takes place. I could, at anytime, contact the University of Hawaii and inform them of the situation if the logo isn't removed. Also, profit made from the logo puts them on even thinner ice.

-Explain that I created a logo set for the school that I would be willing to sell to the High School to further avoid anymore controversy in the future.

So, in short, I don't want to contact Hawaii right away, I think the school deserves a chance to remove the logo before any action is taken.

I was just thinking that while I read the latest posts in here. I'ms ure someone already siad it, but I still want to mention it.

If this was a situation where you knew someone plagerized part of an essay or had proof they had cheated academically, it wold be dealt with swiftly. If anything, intellectual property theft should be punished as well, it's the same wolf under a different looking wool. Why would it be OK to let someone plagerize an image, yet not a series of words?

A similar thing happened a few years ago to Union High School in Tulsa. They were using the Miami 'U' logo without permission and when Miami found out they certainly were less than happy about it. For a while, Union had to remove "The U" from their helmets, uniforms, etc. However, I think the school has recently reached an agreement with Miami to pay a royalty for use of the logo since the Redskins have resumed using it.

Exactly. I have had classmates accused of plagarism in English for far less obvious offenses than this. Plagarism should apply to all classes equally.

On a side note, the team that Union High is playing is using the Nike Miami jersey template and number font... There's a complete Hurricanes uniform on that field!

Yup, the pics are from the Hoover/Union game earlier this season, or perhaps more fittingly, the "Hurricane Bowl"

My advice would be to document the problems that could happen as bullet points and take them to your meeting with the administrator.

i.e.

* We are exposing the school to potential litigation.

* We have been advised of the issue and taken no action.

* The cost of the alternative is $

* Cost of no action, find actual examples, eg find out what Union pays Miami, and any other examples of similar logo copying.

Expand on each point at the meeting.

In other words, your plan is:

* To bring to the attention of a school administrator the fact that a fellow student has knowingly passed-off work other than his own as an original creation;

* Point out that if the school chooses to ignore the aforementioned situation it could be opening itself up to legal action;

* Oh, so conveniently offer up the fact that you just happen to have an original logo package that you'd be willing to sell to the school.

Do yourself a favor...

1) Wear the University of Hawaii t-shirts that you've ordered to school for a few days. Sooner or later, some member of the school administration/faculty is going to notice said t-shirts and wise-up. The result will be that this other student will be called on the carpet to explain why he attempted to pass-off someone else's trademarked material as his own. Further, your school can discontinue use of the University of Hawaii's trademarked logo before they're legally - and, perhaps, financially - complelled to.

2) Go to a member of the school administration and point out that you - as a sports logo and graphic design enthusiast - have noticed that another student has been passing-off the trademarked logos of a major American university as his own work. The result will be the same as in the first scenario.

However, if I were in your shoes, under no circumstances would I attempt to profit off of this little fiasco. The way things have progressed, you run the risk of being perceived as a manipulative opportunist by members of your school's administration and faculty if you bring the other student's wrong-doing to light while simultaneously offering up a solution by which you'll personally profit.

Ah, you're right about the profit deal, I didn't even think about that, I don't want to come off sounding like a rat or something. I just want this logo removed, and to show them that there are alternatives to stealing logos, just stop the plagarism.
