The family is just trying to pursue an investigation into how the military handled it and to see if the military covered up the real reason on purpose. According to Wikipedia (standard disclaimer, blah blah blah), the true nature of his death wasn't revealed until more than a year later. He died in April of 04 and we didn't find about the friendly fire until 05.
