A verbal "I quit" to some jabroni in the clubhouse is not the same as filing formal retirement papers or even saying "I quit" to someone in management, which (and I ain't no lawyer) doesn't even really mean anything unless it's followed up by actually not showing up when told to (I can't imagine that cleaning out a locker matters either, despite the obvious impression that it makes.) Remember, the MLBPA is the strongest player organization in sports, and one of the strongest "labor" unions in the country. No way he's just cut without pay. No way he's just cut without pay.I tend to think that it probably won't happen, but I don't know. I can't recall a case like this so I really don't know what if any prcedent there is.. The Cubs will try to argue this though. They will point to the fact that he's threatneed to retire before, so this is not an out of the blue incident. This is something that could have been thought out. If they can prove that it was thought out in advance they might have a case. They won't rule that he's retired and therefore inelgable to sign with any team. You would need to fill out the formal paperwork for that. But they may have enough to say that he clearly doesen't want to be a Cub and by making these threats about retirement and by actually appearing to follow through on it in one case, he's done enough to void his contract.Will it work, I have no idea. I haven't seen any case like this before and have no idea what if any legal precedent something like this has. If the union can argue that the court would have to be setting legal precedent to do it, good chance the court won't follow through on it.At the very least they will get conduct detrimental to the team. Every Carlos Zambrano craplosing is The Last Straw, so why should I believe this one is? Bottom line is the Cubs cannot afford $18 million (or close to it) in dead payroll. They have all the leverage here. All they have to do is make it known that they want him back but it's his decision, and they're ready to play him when he's ready. If he's serious about quitting and walking away from the money he's owed, he'll do it. Guys 2nd on the team in HR's and 3rd in RBI's... sure his overall numbers are not great, but if he was hitting so bad, why the hell was he their #3 hitter? So it will be very interesting.I've seen him twice this year and the first time I was at a game in San Francisco where he absolutely murdered a ball served up by Sergio Romo. I think it was the first run Romo had given up all year at that point too. He hasn't seen much of them yet, but he has seen some of them, and he's done fairly well. When that guy gets ahold of the ball he absolutely crushes it. You can even hear his grounders from the top deck he hits them so hard. The guy is 12-5? this year and has gone 5+ innings in every single game of his career. He had a handful of games this year when he struggled a bit (hence the 5 losses) but overall he usually gives the Tribe a chance to win. His only weaknesses would have to be predictable pitches and giving up a good amount of home runs. A majority of his pitches are strikes, and once batters realize this they start to get hits off of 1st or 2nd pitches. Swinging early in counts can result in contact, but this makes it easier for him to get through innings very quickly causing fast outs. I'd say with all the Ubaldo Jimenez and Masterson talk, people don't seem to pay much attention to Tomlin. But he really solidifies our starting lineup. Its rare to see a team promote or demote a guy this time of year for a reason other then injury.He did however criticize Hanley Ramirez the other day and while nobody else may like Hanley he is Jeffrey Loria's boy.
