In the last game against Detroit, the time from ten minutes left to one minute left was probably the longest nine minutes of my life. But from one to zero was probably the greatest time I've ever had. I didn't want the clock to run out. It was such a great feeling: people crying in the stands, people jumping up and down, people cheering. Guys couldn't even sit up on the bench. It's okay to be inspired by or even directly take certain elements, but you can't be "substantially similar" to the original copyrighted mark or similar enough to the protected trademark to create a "likelihood of confusion" in the marketplace. Because it's hard to tell ex ante what will be considered infringing in copyright and trademark law, it's always better to be as original as possible in your creations rather than being derivative of others' creations. Stealing is stealing and I don't think a blatant ripoff is going to hold up no matter how "percent" changed it is. As a matter of law, I disagree. The standard for trademark infringement is likelihood of confusion on the part of consumers that the good/service originated from the same trademark owner. If you make enough changes to a trademarked logo, you get to a point where there is not likelihood of confusion. Copyright infringement, on the other hand, requires both evidence of copying and that the intended audience would recognize substantial similarities between the two marks. Again, if you make enough changes to the copyrighted logo, you'll get to a point where the logos are no longer substantially similar. From a legal standpoint, it is possible to start with a trademarked and copyrighted logo and make changes such that what results does not infringe the original logo's trademark or copyright.
