Part of me says, "If he wants the rights to that logo, he should ask the GBL to reactivate the Mesa Miners then!" Another part's saying "Just shut up".

Both have worked out a compromise. Now I say: "They did what they could for this season, but they BETTER get a redesign for next season!"

(then again, I'm frequently surrounded by semi-pro football, so ripoffs occur on a daily basis there)

That's the dumbest statement I've heard in a long time. Someone stole his work, and we're talking hours if not weeks or months of work, and you sit there and say, "Just shut up"? *shakes head* Oh and he doesn't have to ask the league to reactivate the logo, it's his unless he sold it to them outright, so unless he sold all artwork to them outright, then he OWNS the logo,

I meant "Just shut up" in that I should just stop posting in this topic...shoulda phrased it better. And yes, I put my foot in my mouth here (things like this usually happen when you've had too much Merlot...I'm going to stop posting in this thread and use my energy for threads for which I can give better input).

So, do y'all forgive me now that I've backed down from my old stance?

Man, I'd be so pissed off.

I'm curious as to how all this will play out and what you did/do to protect your creations, Studio Simon.

They took the time to mash up and steal two logos, why couldn't they just create their own design?? Amazing.

By the way, that Mesa Miners logo is awesome!

It looks similar, but I don't think that's the logo. I know I've seen the arm/chest part of "their" logo somewhere else.

I would describe the offending logo as a "FRANKEN-LOGO." Let's mash up some old parts and give it <Gene Wilder> LIIIIIIIIIIIIIIIIFFFFFEEE!!! </Gene Wilder>

Besides, they're not similar enough where a lawsuit can happen:

Mesa Miners logo: Mesa_Miners_Main_Logo.png

Arkansas Diamonds logo: ArkansasDiamonds.PNG

Maybe the same company made both logos? I have no idea...

Take a second look at that face, it's a complete rip job. The only reason it's not the exact same is because the Diamonds "designer" probably didn't have a vector version and just live-traced/auto-traced the Mesa Miners face. Also, the structure of that arm is the same as in the UTEP logo, it's just that most of the straight lines have been curved, but I would bet your paycheck that whoever "designed" the Diamonds logo used that UTEP Miners arm as a base. At least they didn't rip off the old (original?) Diamondbacks wordmark. Actually, I'm quite surprised they didn't go that route. :P

This is happening with ever-increasing frequency -- in the past couple of weeks alone, I have been alerted to four such instances of an identities developed by Studio Simon having been "co-opted" in this manner.

Might one of those instances have involved the New England Collegiate Baseball League's Bristol Nine co-opting the Stockton Ports' old Mudville Nine identity?

I have notified the Golden Baseball League of the theft of their intellectual property, and they have indicated that they will be (if they have not already been) in contact with the Diamonds' ownership. What happens now remains to be seen.

It should be noted that once a client pays us for our services, the ownership and all rights to all of the artwork that comprises the chosen direction are transferred to the client. So in instances where artwork is stolen in this manner, the creator of the artwork (in this case, Studio Simon) has no legal recourse -- any actions against the offending party have to come from the client (in this case, the Golden Baseball League) who now owns the artwork.

Regarding other recent instances of identities developed by Studio Simon having been "co-opted" in this manner, Brian in Boston asks "Might one of those instances have involved the New England Collegiate Baseball League's Bristol Nine co-opting the Stockton Ports' old Mudville Nine identity?" In a word: Yes.
