Broncos could be in trouble with Texas A&M after fan flag

Not even Tim Tebow can help the Denver Broncos out of this jam.

Just as the Broncos survived a wild first round of the NFL playoffs by beating the Pittsburgh Steelers on Sunday, their trouble was just starting off the field.

A spokesperson for Texas A&M University said the school might take legal action against the Broncos for using the school's trademarked "12th man" phrase before Sunday's game, according to KBTX TV in College Station, Texas.

Jason Cook, the vice president of marketing and communications at Texas A&M, on Sunday said on Twitter:

"FYI Broncos, the 12th Man belongs to Texas A&M. We saw the flag today and will defend our trademark."

The Broncos, during pregame festivities at Sports Authority Field, had a man parachute into the stadium holding a "12th man" flag.

The Seattle Seahawks did something similar for their playoff game last season against the New Orleans Saints. In that case, Texas A&M threatened legal action and the two sides settled out of court, after the NFL team was forced to pay the school a fee. They now have a contract that allows the Seahawks to use the phrase.

Broncos rookie Von Miller, already a Pro Bowl selection, is a former star linebacker at Texas A&M.

The Broncos-Steelers game Sunday was the most watched NFL game of the year in Denver, by far, according to CBS.

My dad is an Aggie, and he's always been pretty annoyed with A&M doing all this legal stuff surrounding it. The Redskins use it at every home game in various forms, so I guess they must have some legal right.

To be fair, it did start with A&M. My dad told me something about a player in the stands having to suit up due to injuries (he never got to see the field however) back in the 1940's.

Don't the Seahawks do this as well?

EDIT: wow, good timing ^ :P

To add though, didn't they even retire the #12?

Everything about this is ridiculous. 1) "12th Man" is kind of stupid. 2) How can someone trademark "12th man" since football teams around the country and soccer teams around the world have been using it for decades. 3) why would you even sue someone over a goddamn flag? Who cares if it was there? Was hurting A&M in any way? No. No it wasn't.

Here's an idea, Texas A&M - win more than 6 games consistently. Then you wouldn't have to resort to threatening lawsuits against NFL teams and whining about the Longhorn Network to get in the news.

This comment is the epitome of awesome. Hook 'em Horns!

(Texas is like my 2nd favorite college football team after USC. Yes, the National Championship game a few years ago was conflicting.)

The Broncos have been using the "12th Man" for quite awhile now (as I assume a lot of football teams do). They've been using the slogan since at least the opening of Sports Authority Field, possibly longer. It's weird that A&M is only noticing it now.

For the record, to those bitching about A&M trying to stay in the news, the school MUST defend the trademark if they want to keep the protection in the future. If a potential future defendant could show that A&M knew about this infringement and didn't act on it, they could lose their trademark protection and all rights associated with it.

The Seahawks raise a 12th man flag at nearly every home game, and have for a while with Qwest Field. And if you want to get real technical Texas A&M's new SEC rival Alabama (Roll Tide) have more of a right to the 12th man because we had a 12th man actually take the field and make a tackle against Rice. We just don't need it, because we let our 100,000+ speak for themselves

A&M's history is pretty old. They literally had a student come down from the stands to be the 12th man after injuries in 1922. He didnt get in but he was the last one on the sidelines, the 12th man. They started it all.

This 12th man crap is on the save level of obnoxious as the annual 72 dolphins team blowing each other when their record remains intact.
